1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the GBP Leads platform and services provided by GBP Leads ("Company," "we," "our," or "us"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
We reserve the right to update these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
GBP Leads is a software-as-a-service platform that enables users to search for publicly available Google Business Profile data, aggregate results into a personal Data Vault, filter and segment leads, enrich contact information from public sources, and export data in CSV format for use in CRM systems and outreach workflows.
The Service provides access to publicly available business information and does not guarantee the accuracy, completeness, or currency of any data returned. All data is sourced from public directories and is provided on an "as-is" basis.
3. Accounts and Registration
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorized use of your account.
You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By registering, you represent and warrant that you meet these requirements.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in any activity that we determine to be harmful to the Service or other users.
4. Subscription Plans and Billing
The Service is offered on a paid subscription basis. By selecting a subscription plan, you agree to pay the applicable fees as described on our pricing page. All fees are stated in US dollars and are exclusive of applicable taxes unless otherwise noted.
Billing: Subscriptions are billed monthly or annually in advance, depending on the plan you select.
Automatic renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
Price changes: We may change subscription prices at any time. We will provide at least 30 days' notice of any price increase. Your continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.
No refunds: Except as described in our 7-day money-back guarantee below, all fees are non-refundable. We do not provide refunds or credits for partial months, unused searches, or unused features.
7-Day Money-Back Guarantee: New subscribers may request a full refund within 7 days of their initial purchase by contacting [email protected]. This guarantee applies to first-time purchases only and does not apply to renewals or plan upgrades.
Failed payments: If a payment fails, we will attempt to retry the charge. If payment remains outstanding after reasonable attempts, we reserve the right to suspend or terminate your account.
5. Search Limits and Usage
Each subscription plan includes a defined number of searches per week as described on our pricing page at the time of purchase. Search allocations do not roll over between weeks. Unused searches expire at the end of each weekly period.
You may not circumvent, attempt to circumvent, or assist others in circumventing search limits through any means including but not limited to creating multiple accounts, using automated tools, or any other method. Violation of this provision may result in immediate termination of your account without refund.
6. Acceptable Use
By using the Service, you agree not to:
Use the Service for any unlawful purpose or in violation of any applicable federal, state, local, or international laws or regulations
Use the data obtained through the Service to send unsolicited bulk commercial messages (spam) in violation of applicable anti-spam laws including the CAN-SPAM Act
Harass, threaten, or intimidate any individual or business identified through the Service
Attempt to scrape, crawl, or otherwise extract data from the Service beyond your authorized plan limits using automated tools
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
Resell, sublicense, or redistribute data obtained through the Service without express written permission
Use the Service to build a competing product or service
Introduce viruses, malware, or any other harmful code into the Service
Impersonate any person or entity or misrepresent your affiliation with any person or entity
We reserve the right to investigate and take appropriate action against users who violate these provisions, including suspending or terminating accounts and reporting violations to law enforcement.
7. Data and Intellectual Property
Business data surfaced through the Service is derived from publicly available sources. You acknowledge that this data is provided for your business use and that you are solely responsible for how you use it, including compliance with all applicable laws.
All software, code, interfaces, design, text, graphics, logos, and other content comprising the Service (excluding third-party business data) are owned by or licensed to GBP Leads and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for your internal business purposes during your active subscription period.
Nothing in these Terms transfers any ownership of intellectual property to you. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
9. Third-Party Services
The Service may integrate with or link to third-party services, including CRM platforms, email providers, and payment processors. Your use of any third-party service is subject to that service's own terms and privacy policy. We are not responsible for the practices, content, or availability of third-party services. Any issues arising from your use of third-party integrations must be resolved directly with the applicable third party.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GBP LEADS DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE ARE NOT RESPONSIBLE FOR THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THIRD-PARTY BUSINESS DATA SURFACED THROUGH THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, GBP LEADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless GBP Leads and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, or your infringement of any third-party rights.
12. Termination
You may cancel your subscription at any time through your account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to the Service through the end of your paid period.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination for cause (e.g., violation of these Terms), no refund will be issued. Upon termination by us without cause, we will provide a prorated refund for any unused prepaid subscription period.
Upon termination, your right to use the Service ceases immediately. Any data in your account may be deleted after 90 days following termination. We encourage you to export any data you wish to retain before canceling.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which GBP Leads is incorporated, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
YOU AND GBP LEADS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms you have agreed to, constitute the entire agreement between you and GBP Leads with respect to the Service and supersede all prior agreements, representations, and understandings. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision.
